What these terms cover
These terms apply to goods bought through the checkout on this site, currently the bat dongle (model BAT-1). Listening post subscriptions are agreed separately in writing and are not covered here.
Price and payment
Prices are in pounds sterling and include VAT at the current rate. Shipping is charged at the rate shown before you pay. Payment is taken in full at checkout by Stripe on our behalf; we do not see or store your card details. Your order is accepted when Stripe confirms payment and we email a receipt.
Delivery
We deliver to addresses in the United Kingdom only. We dispatch within 7 working days of your order by Royal Mail Tracked 48 and in any event within 30 days, as the Consumer Rights Act 2015 requires. If we cannot meet that we will tell you and you may cancel for a full refund. Risk in the goods passes to you on delivery.
Cancelling and returning
If you are a consumer you may cancel for any reason within 14 days of receiving the goods, under the Consumer Contracts Regulations 2013. How to do that, and how refunds work, is on the returns page.
Your legal rights and our warranty
Under the Consumer Rights Act 2015 the goods must be of satisfactory quality, fit for purpose and as described. Nothing in these terms reduces those rights. On top of them we give a 12-month warranty against faults in materials and workmanship, set out on the returns page.
Using the goods
The bat dongle is a USB audio device intended for recording sound. It is not water resistant and is not a safety, medical or measurement instrument. Bats and their roosts are protected by law; surveying them may require a licence, and that is your responsibility.
Liability
We are responsible for foreseeable loss caused by our breach of these terms or our negligence. We do not exclude or limit liability where it would be unlawful to do so, including for death or personal injury caused by negligence, or for defective products under the Consumer Protection Act 1987. We are not liable for business losses if you buy as a consumer.
Business buyers
If you buy for a business you may enter a VAT number at checkout and receive a VAT invoice. We also accept purchase orders by email; those orders are invoiced and are subject to these terms with the consumer cancellation right replaced by our returns policy.
Governing law
These terms are governed by the law of England and Wales and the courts of England and Wales have jurisdiction. If you live in Scotland or Northern Ireland you may also bring proceedings there.
